Introduction

SHARKNINJA APAC HOLDING PTE. LTD. and its affiliates ("Company," "our," or "we") know how important privacy is to our customers. This Policy explains how we collect, use, and store your personal information, and what rights you have under this Privacy Policy ("this Policy").

This Privacy Policy describes the types of information we may collect from you, or that you may provide, when you use our products and services, including our mobile application Shark Robots (the "App") and any related non-public interactions with us through the App (collectively, our "Service"). It also describes our practices for collecting, using, maintaining, protecting, and disclosing that information.

We undertake to comply with the data protection laws applicable in the place where you reside in order to protect your personal privacy and data security, and we ensure that our staff perform the obligations described in this Policy. We collect, store, use, and share your information to provide you with better services and to improve the quality of our products, including supporting the development of new products and feature upgrades.

This Privacy Policy is incorporated into, and subject to, the Terms of Use for the products and services you use. Certain Shark Robot products and services may have separate privacy policies; where there is a conflict between this Policy and such a separate policy, the separate policy prevails, and anything not specifically covered remains subject to this Policy.

Please read this Policy carefully to understand our practices regarding your information. If you do not agree with this Policy, please do not use our Service. By clicking "Agree and proceed" during registration, or by using our Service, you confirm that you have read, understood, and agree to this Policy.

1. Information We Collect About You

We may collect information about you directly from you, and automatically through your use of the Service. Some of the information we collect is referred to as "personal information" or "personal data" in this Policy — that is, data that can identify you or that we can relate to you, such as your name or email address.

1.1 Information You Provide to Us

An App account is required to use the App's functions on your mobile device ("Your Mobile Device") once downloaded, and will accordingly aggregate data you provide and receive through the App. When you register and log in, we collect your email address and verification code, login password, login token, and country or region code. To continue using the App, you may provide further personalized account information, such as a profile picture and nickname, which we use to maintain your personalized interface.

After registering, you can set a password. When you first set, or later retrieve or change, your account password, you may provide your email address, to which we will send a verification message.

  1. Customer support

We provide customer support and receive questions and feedback through designated contact channels, including email. Our customer support service does not automatically verify your identity; to help us understand and resolve your issue, you may be asked to provide personal information such as your name, email address, delivery address, contact number, product model, and relevant images or videos. Providing this information is voluntary, but failure to provide necessary details may affect our ability to process your request efficiently. When you contact us, we may also collect information associated with your account and device, including account ID, device identifiers, order information, and other relevant identifiers, together with the content of your communications with us. Where applicable, your correspondence history may be retained for record-keeping and follow-up purposes.

When you use Shark Robot products through the App, you may provide device-related information, such as:

In addition to information you provide, we also collect and use information generated through your use of the Service via the App; not all of this information is personal information.

a) Notices

We send device notifications and system messages within the App, and may display marketing content by notice (which you can disable via "Profile" – "Settings" – "Message settings" – "Activity information"). To send these messages, we need access to your mobile device's notification permissions, and we collect account information (account ID), device ID and model, and mobile device information.

b) User research

We may invite you to participate in user research activities. If you choose to participate, we may use your App account and email address to send you notifications via the App or email; you can opt out at any time by adjusting your preferences or through the message interface. Depending on the activity, we may collect a trial product delivery address, survey responses, trial report details, and contact information for feedback. This information helps us publish results, conduct follow-up, maintain communication with participants, and distribute gifts or trial products. Declining to provide this information may result in being unable to participate in the activity or receive associated gifts or trial products.

2. How We Use Your Information

We process your data on reasonable legal grounds, including your consent, the necessity of contract performance, our legitimate interests, and legal requirements. Specifically, we collect your information to:

3. How We Share Your Information with Third Parties

In the following circumstances, we may engage third-party service providers to process your personal information on our behalf for specific purposes:

3.1 Within Our Corporate Group

We may share personal information we collect, or that you provide, with our affiliates in order to provide or improve our products or services, including offering products or services tailored to your requirements.

3.2 Third-Party Platforms and Partners

Certain services incorporate third-party providers, including IT support, customer assistance, data analytics, third-party account login, push notifications, payment processing, QR code scanning, bot/behavioral verification (CAPTCHA), real-time video communication, cloud computing, and similar offerings. To enable these services, we share the minimum necessary personal information with such third parties, through APIs and SDKs, and we disclose their relevant data protection measures where applicable. Before using a third party's services for the first time, please review that provider's own agreements and privacy policy.

3.3 Business Transfers

In the event of a merger, acquisition, restructuring, sale of assets, insolvency, or similar transaction, your personal information may be transferred to the relevant third party as part of that transaction. We will take reasonable steps to ensure the recipient handles your personal information consistently with this Policy.

We may disclose your personal information where required or permitted by applicable law, regulation, or legal process, or where we reasonably believe disclosure is necessary to protect the rights, safety, or property of SHARKNINJA APAC HOLDING PTE. LTD., our users, or the public.

4. Cross-Border Transfer of Your Personal Information

Your personal information may be stored on servers located in Singapore. In addition, support personnel located in People's Republic of China (PRC) may access your personal information for troubleshooting purposes.

This means your personal information may be transferred to, or accessed from, countries or regions outside your country of residence, whose data protection laws may differ from those of your jurisdiction.

Where we transfer personal information across borders, we take steps designed to ensure it remains protected in accordance with this Policy and applicable law. Depending on the jurisdiction and recipient, this may include one or more of the following: entering into data transfer agreements or standard contractual clauses with the recipient, relying on a recognized adequacy or comparable-protection mechanism, implementing access controls and security safeguards, obtaining your consent where required, and limiting access to personal information to personnel on a need-to-know basis. The specific mechanism used will depend on the requirements of the law applicable to you.

5. How We Protect Your Information

5.1 Protection Measures

We have implemented measures designed to secure your personal information from accidental loss, unauthorized access, use, alteration, and disclosure, including encryption for data in transit and at rest, access controls, and confidentiality commitments limiting data access.

The security of your information also depends on you. If we have given you, or you have chosen, a password, please keep it confidential and do not share it, and be careful about sharing information in public areas such as message boards, as it may be viewed by other users.

We take reasonable measures to protect your personal information, but no method of transmission or storage over the Internet is completely secure. We cannot guarantee the absolute security of information transmitted to or from the Service, and any transmission is at your own risk.

5.2 Handling of Security Incidents

Personal information security incidents may occur despite our efforts, due to technical limitations or malicious acts beyond our control. If a security incident occurs, we will, in accordance with applicable legal and regulatory requirements, promptly inform affected individuals of: the basic facts of the incident and its possible impact; the measures we have taken or will take; suggestions for independent prevention and risk mitigation; and any applicable remedial measures. We will notify you via email, letter, telephone, or push notification where practicable; where individual notification is not practicable, we will publish an announcement through other reasonable and effective means. We will also report security incidents to the relevant regulatory authorities where required by applicable law.

6. Retention Period

We retain personal data only for as long as necessary to fulfil the purposes described in this Policy, including to comply with our legal obligations, resolve disputes, maintain information security, enforce our legal rights, terms and policies, or as required by applicable local law. We determine retention periods based on factors such as the amount, nature, and sensitivity of the data, the purposes for which it was collected, applicable statutory limitation periods, and any ongoing legal, regulatory, or contractual requirements.

After the purpose of collection has been fulfilled, or after we have confirmed your request for deletion or withdrawal of consent, or after the applicable product or service is discontinued, we will cease storing your personal data and delete it within a reasonable period, subject to any legal or technical constraints described in Section 7.2.

We will also retain records of your consent to our collection and use of personal information, and of any subsequent changes to or withdrawal of that consent, to meet legal obligations and potential litigation requirements; we will avoid collecting new personal information for this retention purpose beyond what is necessary.

7. Your Rights and Choices

Depending on the data protection law that applies to you, you may have some or all of the rights described in this Section. Where local law provides additional or different rights, those local requirements will apply.

7.1 Access and Correction

You may access and correct your personal information directly through your account settings within the App at any time. For security, identity verification, or mandatory legal reasons, you may not be able to modify certain initial registration information. If you are unable to access or correct your personal information through the App, please contact us using the details in Section 11 for assistance. We will continue to develop user-friendly interfaces to facilitate self-service; please watch for future App updates.

7.2 Deletion

You may request deletion of your personal information by deleting your App account, or by contacting us using the details in Section 11, including in the following circumstances:

After we assist you with deletion, applicable legal and technical limitations may mean we are unable to immediately delete corresponding information from backup systems. We will securely store, and restrict further processing of, such information until the backup can be deleted.

Where we process your personal information based on your consent, you may change the scope of, or withdraw, that consent by requesting deletion of personal information, restricting the App's permissions on your mobile device, or by other available means, including by deactivating your App account. Certain products, services, or business functions require certain necessary personal information to operate; if you withdraw consent, we will stop the corresponding processing but may be unable to continue providing the related services. Withdrawal of consent does not affect the lawfulness of processing carried out based on your consent before its withdrawal.

7.4 Restriction of Processing

You may request that we restrict the processing of your personal information where: (1) you dispute the accuracy of your personal information and have requested correction; (2) we are investigating a complaint that our processing violates applicable law or our agreement with you; (3) you have changed the scope of, or withdrawn, your consent but relevant information needs to be retained to ensure the continued use of core services; or (4) other circumstances required by applicable law. You may submit a restriction request using the contact details in Section 11, or through the applicable self-service options described in Sections 7.1–7.3. We will suspend non-essential use and restrict sharing and transmission of the relevant personal information until the restriction is resolved.

7.5 Copies and Portability

You may request a copy of your personal information, or request that it be transferred, by contacting us using the details in Section 11.

7.6 Verification

Before responding to the requests above, we may need to verify your identity for security purposes. You may submit requests by email, in-app form, or any other electronic method we make available, and we will not impose any procedure that creates an undue burden. After verification, we will respond within the timeframe required by applicable law, and we will notify any third parties who received your information under Section 3 to help them respond to your request.

7.7 Marketing Communications

Where we send you direct marketing communications, you may opt out at any time using the unsubscribe or preference-management mechanism provided in that communication, through in-app settings, or by contacting us using the details in Section 11. Where applicable local law requires additional safeguards for marketing calls, messages, or registries, we will comply with those requirements.

8. Third-Party Services

Our Service may contain features or links to websites and services provided by third parties. Any information you provide on, or that is collected by, third-party sites or services is collected directly by the operators of those services and is subject to their own privacy and security policies, even where accessed through our Service.

We are not responsible for the content, privacy, or security practices of third-party sites or services linked from or accessible through our Service. If you choose to use such third-party services, please review their privacy policy and terms of use before engaging with them or providing any information.

9. Children's Privacy

Our Service is not intended for children under the minimum age defined by applicable law in your jurisdiction (the "Minimum Age"). We do not knowingly collect personal information from children below the Minimum Age. If you are under the Minimum Age, please do not use or provide any information on this App.

Where we knowingly collect personal information from a child who is above the Minimum Age but is still considered a minor under applicable law, we will obtain verifiable parental or guardian consent as required before collecting such information.

If we learn that we have collected personal information from a child below the Minimum Age without appropriate parental or guardian consent, we will take steps to delete that information as soon as reasonably practicable. 10. Changes to This Privacy Policy

We may revise this Policy from time to time. If we make material changes (such as changes to business functions, cross-border data transfers, purposes of use, or contact information) or changes that may increase your responsibilities regarding how we treat personal information, we will notify you by email to the address on your account, or through a notice on the App's first screen. The date this Policy was last revised appears at the top of this document. You are responsible for keeping an up-to-date, deliverable email address on file, and for periodically checking our Service and this Policy for updates.

We will only collect, use, and store your personal information in accordance with an updated Policy after you confirm your agreement to the relevant changes.
